Malpractice is a legal term used as “malpractice of medicine”. In order for malpractice to be in question, the profession of medicine must be done incorrectly. In order to evaluate malpractice, it is necessary to understand and know the medical profession. Or consultation with practitioners of the medical profession is required. In other words, medical books and literature are the main determinants for the evaluation of right and wrong medical practices. Does the law need complications? Medical books and literature are needed to solve the concept of “or not” and to evaluate whether the subject is in malpractice. Both issues appear as situations that need to be evaluated in medicine.
However, the main mistake in this regard is that the belief in medical books describing a disease is very high, and the belief in the situations that the same books describe as complications is not very high. However, it is the science of medicine that determines both. There is a double standard here. If the concept called complication exists in medical science, you have to believe it.

It is not a person who makes the truck, the car, the television that makes the human being. All the technological tools made by humans are still managed by humans. Man governs himself. All the technological tools that people make are the same. And it is lifeless. Humans contain different structures. Their metabolisms are different.
You can’t kill a person, remove all his organs and put them back on, but you can disassemble all the technological tools made by people and put them back into operation. When you put diesel fuel in all gasoline cars, the answer for all gasoline cars is the same, but the answer may be different for humans. Some people can’t eat red meat, some people can’t eat fish, some people can’t eat pain. These examples can be increased a lot.
Complication is actually a situation arising from human variability, obscurity, inability to be detected, and confidentiality. It is a necessary condition as long as medical science exists. What do these mean? How can a person be unknowable, undetectable, hidden?

However, from a medical perspective, the term “complication” is used. After all, there is a death, some circles state that it will not fit in the conscience of the society. Some circles may say that the doctor is hiding behind complications. In fact, all those who make such judgments want the physician to be punished. So why?
It is unknown who will contribute to the punishment or even death of the physician. In fact, this situation is a trauma that the physician will experience every day, every day, that he will be afraid of.
It is not the physician who created the tonsil. There are certain reasons for the removal of tonsils. Such as frequently recurring sinusitis, frequently recurring ear infections, presence of acute joint rheumatism, respiratory problems. Whoever does this is not a doctor. Physician recommends tonsil surgery. He does not force the operation to me, he does not say that you will be in the medicine. The decision maker is the patient and their relatives. The patient or his relative decides and the operation is performed. 99% of people will say “May Allah be pleased with you” and 1% of people will say “God bless you”. Problems begin when problems develop or even disappear in the patient. Now, “it is a bad doctor who does the surgery. It is the one who kills his patient. However, 99% of people say God bless you. Now why has there been death? Or why have problems developed? Or why was it operated? Wouldn’t it have happened without the surgery? Questions will come up.
When viewed from the perspective of physicians, perhaps hundreds of thousands of surgeries have not experienced such a problem, but there have been people who did. However, he will judge himself in the face of the existing situation and settle accounts with his conscience, and say, if I had done this, where did I go wrong? But no matter what he does, he will not find the answers. Because a material creature is a human being with different reactions, different anatomies, different metabolisms, different perceptions and different desires.
Because the discomfort called tonsils is different. The features are different. Their vascular structures are different. The veins vary in size. Neighborhoods are different. The coagulation characteristics of people are different. The conditions and severity of existing infections are different. Even if you take all the safety precautions, it is clear that you cannot manage these factors even if you are a very good surgeon.

Then what will you do when a brain abscess develops as a result of recurrent sinusitis attacks, when he has frequent lung infections and has lung disease, when hearing is lost due to recurrent middle ear infections, when he has kidney and heart valve disease due to acute joint rheumatism.
Medical science has a feature. There is more or less risk in every application you make. If the risk when you treat a patient is lower than the risk if you don’t, then it is profitable to apply treatment. So medical science is the balance of risks. There is no risk-free medical science.
Now, what will the physician gain by performing this operation? Let’s look for an answer to the question. It will be answered with plain logic. I seem to hear the sound of money. How much will he earn? For example, 100 lira. If this surgery is problematic, how much will he lose? 25,000 pounds. In other words, this doctor needs to perform 250 tonsil surgeries so that he can earn this money. There is no guarantee that the problematic one will not come out of 250 surgeries. Unfortunately, this is the point reached for medical science. Two groups of physicians have developed, now the first group is trying to fulfill the requirements of medical science, and the second group is self-protective. Unfortunately, the group, which is trying to fulfill the requirements of the 1st group of medical science, has started to shrink rapidly with each passing day. And if it goes on like this, they will never stay.
The science of medicine continues to be worn down by the practices, punishment methods and ignorant comments. The main problem is that there is no authority to distinguish between practitioners of medical science and legal practitioners. That is the absence of legal practitioners who know medical science. This problem allows the political use of medical science. The problem is serious. The future is at risk. An unhealthy, worn-out society awaits us. For this reason, it should be within the framework of legal practices within the scope of medical science. Legal practices should come into play if there is malicious intent in the application of science. Otherwise, knowledge banks, which are formed with the accumulation of centuries in medical science, should not be on the concepts that all the books call complications.
